Asheville Fence Company Workmanship Warranty

This page explains our workmanship warranty in full. Your signed contract contains the same warranty in shorter form; if the two ever read differently, the contract you signed is the one that applies.

Asheville Contracting Co., Inc., doing business as Asheville Fence Company (“Asheville Fence”, “we”, “us”), gives the warranty below on the work described in the estimate or contract this warranty is part of. This is the entire warranty we give. No other warranty, spoken or written, applies to our work.

1. What is covered: our workmanship, for three years

“Workmanship” means how we built the job: how posts were set and backfilled; how rails, panels, pickets, boards, wire and fabric were fastened; how gates, hinges, latches and hardware were hung and adjusted; and how gate equipment we installed was mounted and connected.

For three years from the completion date of the work (the date we finish the installation, as shown on your invoice), if the work fails because of how we built it, we will repair or replace the affected work at no charge to you, including the materials that fix needs.

Covered means the fence or gate no longer does its job because of how it was built. For example:

  • a post that leans or works loose because of how it was set or backfilled
  • a gate that sags, drags, or will not latch or close because of how it was hung or adjusted
  • rails, panels, pickets, boards, wire or fabric that come loose or separate because of how they were fastened
  • gate equipment we installed that fails because of how it was mounted, aligned or wired — the equipment itself is not covered

This warranty covers whether the fence and gate work, not how they look.

2. What is not covered

a. The materials themselves. Wood that warps, cups, twists, cracks, checks, shrinks, splits, fades, greys or rots; metal that rusts or corrodes; vinyl or composite that fades, chalks, becomes brittle, cracks or discolours; fasteners, hinges, latches and other hardware; and any manufacturing or factory defect in any product. Manufacturer warranties are separate from ours: see section 3. When a failure is our workmanship, the materials needed for that fix are on us, as set out in section 1.

You acknowledge that wood is a natural material: wood fences and gates shrink, warp, crack, check, split and chip as they dry and weather. This is normal and expected, it is not a defect in our work, and it is not covered by this warranty.

b. Gate equipment and electrical work. Gate operators, keypads, intercoms, cameras, receivers, remotes, sensors, loops, batteries, solar panels, transformers, wiring and any power supply. The equipment is not covered; how we installed it is.

c. Acts of nature and other outside causes. Acts of nature, acts of God, and any other cause outside our work, including storms, wind, rain, snow, ice, hail, lightning, fire, flood, standing water, falling trees or limbs, earthquake, landslide, frost heave, and ground that shifts, settles, erodes, washes out, freezes or becomes saturated; and vehicles, equipment, mowers, trimmers, animals (including pets and livestock), insects, vandalism, theft, accident, misuse and abuse.

d. Other people’s work, alterations and modifications. Any alteration, modification, addition, relocation, removal, repair or adjustment to the fence, gate or gate equipment by anyone other than Asheville Fence Company or a party we authorised in writing. This includes attaching anything to the fence or gate (wire, mesh, screening, windscreen, panels, lattice, signs, lighting, plants or vines), and grading, digging, trenching, landscaping, irrigation or paving work near it. It also includes any part of an existing fence, gate or post we tied into, reused or worked around at your request — we warrant only the work we performed.

e. Improper maintenance or misuse. Failure to maintain the fence, gate or gate equipment as set out in our care instructions or the manufacturer’s instructions — including not keeping gate hinges, latches and operators clean, lubricated and adjusted; not keeping gate paths clear of ice, snow, dirt, gravel, mulch and growth; not sealing, staining or painting wood where the manufacturer calls for it; and not keeping drainage away from posts. It also includes propping, overloading, climbing on, hanging from, pulling or forcing gates or fence, and driving into or against them.

f. Normal wear, weathering and appearance. The expected ageing of any product installed outdoors, including fading, chalking, checking, splitting, surface rust, weathering to grey, and the expansion, contraction, movement and gapping that comes with temperature and moisture; and settling or ground movement that is normal for the fence type, the site and our climate. Also not covered: differences in colour, grain, texture, finish or appearance between materials or from a sample or photograph, and how the finished job looks.

g. Repairs, except as the repair estimate states — see section 4.

h. Other losses, and work around the warranty fix. Our obligation under this warranty is limited to repairing or replacing the affected work as described above. We are not responsible for other losses, including damage to landscaping, lawn, plants, paving or structures arising from making a warranted repair, loss of use, or costs you incur without our written agreement.

Work that is not itself the warranty fix is not covered and may be charged. That includes extra time, labor or materials needed to reach the work, or to move, remove, protect or put back other things (such as landscaping, structures, stored items or other fencing), and any other repairs done at the same visit. We will give you the price in writing before we do it.

3. Manufacturer warranties are separate from ours

Any warranty a manufacturer gives on a product we install is that manufacturer’s warranty, not ours. It is separate from this warranty, and we make no promise about whether a product has one, what it covers or how long it lasts. It is assigned to you and belongs to you, to the extent the manufacturer allows. Its terms and claim steps are set by that manufacturer alone, and we do not extend or administer it.

Which manufacturers’ products go into a job depends on the job. Your invoice, given when the job is done, names the manufacturers for your job, so you know whom to contact. If you are not sure who made something we installed, call the office and we will tell you.

If a product itself fails or is defective, you take that up with its manufacturer directly. Our work to put in a replacement part or product is not covered by this warranty and may be charged, with the price given in writing first. If the problem is how we installed the product, that is our workmanship, covered under section 1.

4. Warranty fixes and charged repairs

  • A warranty fix is free. It is work covered under section 1, on a fence or gate we installed, reported within the three-year period.
  • Everything else is a repair, and repairs are charged. That means work on anything this warranty does not cover, and any work after the three-year period has ended. You get a written estimate before any charged work starts.
  • The three-year workmanship warranty in section 1 applies to new fences and gates we install. It does not apply to repair work.
  • Every repair estimate states its own warranty in writing before any work starts — what is covered, for how long, or that the repair carries no warranty.
  • Some repairs are temporary. They are meant only to keep a fence standing or usable, not to return it to new condition, and they carry no warranty. The estimate says so before the work begins.
  • A repair does not extend, restart or add to any warranty on the rest of the fence, gate or equipment.
  • When you make a warranty claim and part of the work is not covered: we will show you in writing which part is covered under this warranty (at no charge) and which part is not, with the price and any conditions for that work, for your approval before we do it.

5. Who is covered

This warranty is for the customer named on the contract, at the property address on the contract. It does not transfer to a later owner or occupant of the property, and it ends if the property is sold. It applies only if your entire account with us is paid in full — every job and invoice, not only the work the claim is about.

6. How to make a claim

Call the office at (828) 665-8900 within the three-year period and within 30 days of finding the problem. A problem left alone usually gets worse and can lead to more work and other damage, so reporting it promptly matters to you and to us. Give your name, the property address, and what is wrong. Keep your contract or invoice — it shows the completion date. We need reasonable access to the property to look at the work, and we choose whether to repair or replace. If what we find is not covered by this warranty, we will tell you and can give you a price for the work.

7. Changes

Nothing anyone says changes this warranty. It can only be changed in writing, signed by an officer of Asheville Contracting Co., Inc.

8. Your legal rights

This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
